According to a recent report by WebRecon, court filings under the Fair Debt Collection Practices Act (FDCPA) and Telephone Consumer Protection Act (TCPA) rose by double digits while litigation under the Fair Credit Reporting Act (FCRA) trended slightly down.  Complaints filed with the Consumer Financial Protection Bureau (CFPB) saw a modest increase.

WebRecon reports the overall statistics for consumer litigation in September as follows:

  • 737 FCRA cases were filed, representing a 4.7% decrease from August;
  • 428 FDCPA cases were filed, representing a 22.6% increase from August;
  • 287 TCPA cases filed, representing a 23.7% increase from August; and
  • 28,124 complaints filed with the CFPB, representing an 0.9% increase from August.

Filings are mostly up compared to January 1 to September 30, 2024 (FCRA +30.7%, FDCPA -1.7%, TCPA +57.9%, CFPB +99.5%).
