September 2026 consumer litigation filing statistics are in, and the picture is again a mixed one. Filings under the Fair Credit Reporting Act (FCRA) rose, while filings under the Fair Debt Collection Practices Act (FDCPA) and the Telephone Consumer Protection Act (TCPA) and complaint volume with the Consumer Financial Protection Bureau (CFPB) all declined. Even so, filings remain up compared to the same period last year across every category.
WebRecon reports the month-over-month statistics for consumer litigation in September as follows:
- 1,083 FCRA cases were filed, representing an 11.9% increase from August;
- 357 FDCPA cases were filed, representing a 1.9% decrease from August;
- 191 TCPA cases were filed, representing a 3.5% decrease from August; and
- 21,410 complaints were filed with the CFPB, representing a 2.4% decrease from August.
Compared to the same period in the prior year (January 1 to September 30, 2025), all four categories are up year-to-date: FCRA +43.8%, CFPB complaints +14.2%, TCPA +13.4%, and FDCPA +7.2%.
If these numbers hold over the next few months, 2026 will mark the second year in a row of substantive increases in FDCPA litigation, following a solid decade of declining numbers.
