According to a recent report by WebRecon, court filings under the Fair Debt Collection Practices Act (FDCPA) and Fair Credit Reporting Act (FCRA) rose by double digits while litigation under Telephone Consumer Protection Act (TCPA) trended down. Complaints filed with the Consumer Financial Protection Bureau (CFPB) were also down. Yet, everything is up YTD and looks like it will end that way.

WebRecon reports the overall statistics for consumer litigation in October as follows:

  • 919 FCRA cases were filed, representing a 24.7% increase from September;
  • 493 FDCPA cases were filed, representing a 14.9% increase from September;
  • 235 TCPA cases filed, representing a 18.4% decrease from September; and
  • 26,476 complaints filed with the CFPB, representing an 8.6% decrease from September.

Filings are still up compared to January 1 to October 31, 2024 (FCRA +36.4%, FDCPA +2.9%, TCPA +56.6%, CFPB +93.0%).
