According to a recent report by WebRecon, court filings under the Fair Credit Reporting Act (FCRA), Fair Debt Collection Practices Act (FDCPA), and Telephone Consumer Protection Act (TCPA), and complaints filed with the Consumer Financial Protection Bureau (CFPB) were all down for the month. Everything is up YTD except TCPA filings, and those are only nominally down.

WebRecon reports the overall statistics for consumer litigation in November as follows:

  • 652 FCRA cases were filed, representing a 29.1% decrease from October;
  • 338 FDCPA cases were filed, representing a 31.4% decrease from October;
  • 224 TCPA cases filed, representing a 4.7% decrease from October; and
  • 25,833 complaints filed with the CFPB, representing an 4.7% decrease from October.

Complaints and filings are still mostly up compared to January 1 to November 30, 2024 (FCRA +37.4%, FDCPA +4.1%, TCPA -0.4%, CFPB +90.2%).
