Speakers throughout this webinar series will address cybersecurity and data privacy, the Telephone Consumer Protection Act (“TCPA”), the Fair Credit Reporting Act (“FCRA”), the Fair Debt Collection Practices Act (“FDCPA”), mortgage lending and servicing, and other related consumer finance topics.
The first session, “Data Breach Litigation: How to Avoid It and Be Better Prepared for Defense,” is on May 3 from 3:00-4:00 p.m. E.D.T., and will be hosted by Troutman Sanders partner Ronald Raether and Andrea Hoy, virtual CISO and CEO of A. Hoy & Associates. Over the past decade, consumer data breach litigation has focused on whether consumers who received a breach notice suffered an injury that would allow their claims to move forward. Plaintiffs’ counsel have had some recent success with this issue. From past experience, this usually results in defendants settling cases. The panel will discuss this evolution and the key issues being litigated in these cases.
Building upon this basic understanding, Ron and Andrea will discuss the importance of companies understanding what circumstances give rise to and will sustain a lawsuit. Attendees will learn why some of these lawsuits “die on the vine” while others settle, with very few advancing to witness testimony or e-document production. More importantly, the speakers will provide practical advice on what can be done before and after a data breach to shrink the target and identify inherent risk and controls your company should review to improve your chances of success if litigation does follow and to improve your Information Security Program.
