On Friday, February 21, the United States Supreme Court released its April calendar, scheduling arguments for the final session of this term. In doing so, the Supreme Court put a crucial Telephone Consumer Protection Act case – Barr v. American Association of Political Consultants – on the docket for April 22. Barr involves a challenge to the constitutionality of the TCPA. The Court will hear arguments on whether the TCPA’s exemption for debt collection calls made by the federal government is a content-based restriction on speech, in violation of the First Amendment. The justices also will hear arguments on whether the appropriate remedy – should the exemption be found unconstitutional – is to sever the exemption from the statute or invalidate the TCPA entirely. This promises to be a pivotal TCPA decision.
