We are pleased to announce that Troutman Sanders partner Ron Raether will be a featured panelist at the 2016 USA RSA Conference at the Moscone Center in San Francisco.  Ron will participate on a panel entitled “Data Breach Litigation: How to Avoid It and Be Better Prepared for Defense” on Thursday, March 3 from 11:30 a.m. to 12:30 p.m.   Ron will be joined by Andrea Hoy, the current president of the Information Systems Security Association.  ISSA is the community of choice for international cybersecurity professionals dedicated to advancing individual growth, managing technology risk, and protecting critical information and infrastructure.  RSA is the largest gathering of cyber security professionals in the world and is a forum for them to share their experiences and insights on current threats and best practices.

Over the past decade, consumer data breach litigation has focused on whether consumers who received a breach notice suffered an injury that would allow their claims to move forward.  Plaintiffs’ counsel have had some recent success with this issue.  From past experience, this usually results in defendants settling cases.  The panel will discuss this evolution and the key issues being litigated in these cases.  Building upon this basic understanding, Ron and Andrea will discuss the importance of companies understanding what circumstances give rise to and will sustain a lawsuit.  Attendees will learn why some of these lawsuits “die on the vine” while others settle, with very few advancing to witness testimony or e-document production.  More importantly, Ron and Andrea will provide practical advice on what can be done before and after a data breach to shrink the target on your company and improve your chances of success if litigation does follow.
