On November 7, the Rosen Law Firm, P.A. announced that it had filed a class action lawsuit against national chain Jimmy John’s Gourmet Sandwiches relating to a security breach involving customers’ credit and debit cards earlier this year.  The lawsuit alleges that the company’s grossly inadequate information systems and network security oversight led to an ongoing pilfering of customer credit and debit cards by third parties.

The proposed class action seeks to obtain recovery for customers who used their cards to make purchases at Jimmy John’s in 43 states.  The complaint asserts that despite its awareness of the security intrusion and data theft on July 30, 2014, Jimmy John’s remained unlawfully silent for nearly two months until it disclosed the data breach on September 24, 2014.
